The dump, just off the road, was spotted by a truck driver when he pulled over for a stop and reported in August.
The driver, who asked to remain anonymous, approached the Mercury concerned that nothing had been done to address the problem several weeks after he brought it to the attention of Lithgow City Council and the NSW Environment Protection Authority (EPA).
The EPA confirmed on Friday afternoon, September 27, that it was aware of the illegal dumping.
"The EPA is aware of waste that contains asbestos dumped near the bottom of Mt Victoria pass on the Great Western Highway," a spokesperson said.
"The EPA is investigating the matter and working with Lithgow Council to organise clean up."
