Emirates' luxury One and Only Resort at Wolgan Valley has been fined $15,000 for breaching an approval condition that limits weekly helicopter movements at the resort.
The move follows compliance investigations by the Department of Planning and Environment.
Under regulations by the department the resort is only supposed to allow four helicopter movements per week, but the company “breached this limit on a regular basis” between January 2014 and September 2016.
A spokeswoman from the Department of Planning and Environment said one of the worst breaches was during Autumn.
“During one week in early May [this year]there were 17 helicopter movements in a week,” the spokeswoman said.
The spokeswoman said the company could be prosecuted in the Land and Environment Court if it is found that “the most serious breaches of compliance show significant harm”.
“The department will continue to monitor helicopter movements at the resort [and] ...consider appropriate enforcement action when a potential breach of conditions occurs.”
The department was tipped off about the breaches.
“The investigation commenced in May this year in response to information received by the department.
“Compliance officers regularly inspect major projects across NSW to undertake spot checks and unannounced visits.
